RELIGIOUS DISCRIMINATION

WHAT IS Religious DISCRIMINATION in the employment setting?

In California, it is unlawful for an employer to terminate, demote or refuse to hire any person on the basis of that person’s religion or is because that person is associated with someone i.e. spouse or family member who is a member of a particular religion - to do so is religious discrimination.

DOES MY EMPLOYER HAVE TO ACCOMMODATE MY RELIGIOUS BELIEFS OR PRACTICES?

Yes, in California, an employer has a duty to provide reasonable accommodation for an employee’s religious belief or observance unless the accommodation causes the employer undue hardship. Such accommodation could be allowing an employee time off from work to observe religious holidays or catering to an employee's religious dress or grooming practice.

WHAT ARE YOU ENTITLED TO RECOVER IN A religious DISCRIMINATION CASE?

  • All lost wages, income, earnings or salary you lost, and will lose in the future, as the result of the discriminatory conduct
  • Monetary compensation for your past and future mental suffering, inconvenience, anxiety, humiliation, and emotional distress
  • Punitive damages to deter your employer from engaging in similar conduct in the future
