WHAT CONSTITUTES MEDICAL MALPRACTICE?

A doctor must use the same skill and care that other doctors would use in the same situation. Failure to do so constitutes medical malpractice.

Examples of medical practice include a doctor failing to perform a medical procedure, i.e., surgery with the same skill and care that other reasonably careful doctors would use, or a doctor who fails to timely diagnose and treat a medical condition.
